Pair arrested for shoplifting, criminal conspiracy

Two persons were arrested for shoplifting and criminal conspiracy in connection with a theft they were caught committing at dd’s DISCOUNTS on Hatch Road on Wednesday morning, Sept. 4.

At 11:50 a.m., a store employee was watching Nemyah Wyatt, 36, of Modesto, selecting items in the store and acting suspiciously. The employee recognized Wyatt as being responsible for previous thefts from the store. 

Officers Nicolas Welsh, Pat Dayton and Adam Hall arrived as Wyatt left the store with unpaid merchandise and walked to a car occupied by Jordan Herr, 27, of Modesto. As Wyatt approached the car, Herr popped the trunk lid open for her and she placed the stolen items in the trunk.

Officer Welsh rolled up to the vehicle in his patrol unit with his emergency lights on and Wyatt began walking away as Herr got out. Officer Welsh detained Herr as Wyatt took off running around behind the business. Officer Dayton gave chase after Wyatt and saw her duck into some bushes behind the store. She complied with orders to come out but then took off running again. Officer Dayton apprehended her. 

Officer Welsh confirmed with the employees that the merchandise had been stolen. 

Both Wyatt and Herr were arrested for shoplifting and criminal conspiracy.

Wyatt faces additional charges of resisting arrest.

Herr faces additional charges of being in possession of a dirk/dagger.

Police did not release a mugshot of Wyatt.
