Two convicted for organized retail theft

Two men have been convicted of organized retail theft and related charges stemming from a May 28 incident at the Riverbank Crossroads Shopping Center.

Michael Prunty, 36, of Modesto, and Alberto Gavidia, 44, of Turlock, were found guilty following an investigation by the Stanislaus County Sheriff’s Office. Authorities said the pair entered the Ulta Beauty store during a retail theft operation and fled with more than $1,500 in merchandise stuffed into shopping bags.

Gavidia was also found to be unlawfully in possession of a firearm, according to the DA’s office.

Prunty has been sentenced to 32 months in state prison. Gavidia is awaiting sentencing and is expected to receive a four-year prison term.

The case was prosecuted by Organized Retail Theft Prosecutor Fawn Smolak. Laugero’s office said the Organized Retail Theft Unit was established to combat theft, support local businesses and protect consumers. Under California law, organized retail theft is a felony offense subject to enhanced penalties.

The unit’s mission includes pursuing appropriate sentencing, preventing “catch and release” outcomes, and deterring future crimes, the DA’s office said.
