A 30-year-old homeless man refused to pay for $23.65 worth of food he consumed at Denny's restaurant and then waited outside for police after telling the manager he had no right to detain him as police were called.

The arrest came at 1:25 a.m. on Wednesday, Dec. 10.

Andrew Giddings allegedly ordered eggs and steak, a milk shake and coffee and then walked out without paying his tab. The manager asked him to wait for police and was told he could not hold. Giddings waited for police outside. He told the officer that he had no money and was arrested and booked.

Ceres Police Department spokesman Sgt. Jose Berber said it appeared that Giddings wanted to go to jail.
