DUI suspect released on promise to appear

A 44-year-old Modesto man was released after being cited for misdemeanor DUI and driving on a suspended license after he wrecked his car in a Ceres rollover crash on Sunday, May 15.

Oscar Hernandez Lua, 44, of Modesto was not injured in the 8:42 p.m. in the area of Nadine Avenue and Wizard Lane. Lua’s car was on its top in the middle of Nadine Avenue.

A witness told Officer John Blount that the driver fled the area on foot eastbound on Nadine Avenue and was currently in front of Adkison Elementary School.

Officer Jeff Godfrey located Lua in a school driveway and ordered him on the ground several times, but he did not comply. With minimal force, Officer Godfrey was able to take Lua to the ground where he was handcuffed with assistance from Officer Aaron Pinon.

Lua said he ran from the car to chase after his dog who ran away from the upside-down car.

Lua underwent a series of field sobriety test which suggested he was under the influence of an alcoholic beverage. He admitted to drinking seven cans of Coors Light. A breath test revealed his blood alcohol level at .35 over four times the legal limit.

He was released on a promise to appear citation.
