Man jailed for DUI, drug possession

A 20-year-old Modesto man was jailed Friday evening after an officer pulled his car over and determined that he was both smoking pot and drinking.
The car stop occurred at 8:21 p.m. when Ceres Police Officer Eric Gallegos spotted a vehicle without a front bumper and front license plate driving near the intersection of Hatch Road and Central Avenue.

The officer detected a strong odor of marijuana coming from the interior of the vehicle, which was driven by Giovanni Duran-Delgado, 20. An 18-year-old male passenger in the vehicle was on probation. Officer Gallegos asked if there was marijuana in the vehicle and both men showed a small baggie with marijuana in it. There was also a glass marijuana smoking pipe with burnt marijuana near the center console. Officer Gallegos conducted a search of the vehicle which further yielded an open container of an alcoholic beverage underneath the driver seat and a second open glass bottle of vodka behind the passenger seat.

Duran-Delgado, who had alcohol on his breath, admitted to drinking from the alcoholic beverage container under his seat. He also had watery blood shot eyes and slurred speech, all signs of impairment.

Due to Duran-Delgado being under 21 years old he is not supposed to have any alcohol in his system while driving.

Duran-Delgado was placed under arrest for DUI. The location of the stop - Central Ave north of Hatch Road - was deemed unsuitable for a field sobriety test therefore Giovanni was transported to Ceres Police headquarters to conduct the tests. The conclusion of the test revealed Giovanni was impaired and unable to safely operate a motor vehicle.

While Duran-Delgado was being booked into the Stanislaus County Jail, Officer Gallegos located a small baggie filled with suspected cocaine. He admitted the substance was cocaine and that he bought it in town for $5 and had already used some of it. Duran-Delgado was arrested for DUI under 21 years old, and possession of a narcotic controlled substance.
