Theft of beer turns to robbery with push of intervening clerk

A 36-year-old Tracy man is being charged with robbery after he allegedly stole a can of beer and shoved the clerk trying to stop him early Sunday.

The incident was reported at 3:20 a.m. at the Hatch Road AM/PM. 

The clerk said Emmanuel Fernandez entered the store and grabbed a beer but was told that beer was not for sale at that hour. Fernandez instead took a can and began walking toward the front door. The clerk attempted to block him, telling Fernandez to put it back. Fernandez then reportedly pushed the clerk out of his way as he left the store with the beer. 

Officer Scott Faure  obtained the description and set out to look for the suspect. He was found hiding in bushes near an apartment complex in the 1600 block of Richland Avenue. Fernandez was drinking the stolen beer. Fernandez refused to provide his name or any identifying information.

The clerk positively identified Fernandez as the thief. Fernandez, later identified at the jail, was arrested for robbery. He was found to be on probation so a probation violation charge was added to the charges.
