Theft of drill set turns into robbery charge

A 33-year-old Modesto man faces a robbery charge after allegedly trying to swing at a victim trying to stop a vehicle burglary early Tuesday, May 12.

Officer Kao Saechao was dispatched to the area of Whitmore Avenue and Rockefeller Drive at 12:01 a.m. about a vehicle burglary in the 2500 block of Fiesta Way. The victim reported seeing suspect Mark Osborne, 33, of Modesto, in the process of taking a drill set from his vehicle. When confronted by the victim, Osborne dropped the drill set and began swinging his arms at the victim. The victim believed Osborne had an object in his hand with which he was trying to hit him. 

Osborne was arrested on Rockefeller Drive near Hil-Mor Drive. The victim and a witness positively identified Osborne as the suspect, said Ceres Police Department spokesman Sgt. Greg Yotsuya.
