Man booked for Factory 2 U theft

Sergio Marshall, 41, of Modesto, was arrested Aug. 31 for stealing clothing from a Hatch Road store and threatening to kill the clerk who spotted and stopped him.

Just before 9 p.m. an employee of Factory 2-U at 1450 E. Hatch Road called 911 to report a theft in which Marshall was concealing socks and other items in a personal plastic bag. When the clerk confronted Marshall, he became enraged and threatened to shoot the employee. He then removed the socks from the bag and threw them at the employee's head. Marshall left riding a bicycle westbound in the parking lot.

Officer Kiashira Ruiz located Marshall near the Dollar Tree store in the same complex. A records check revealed Marshall had an outstanding misdemeanor arrest warrant for domestic violence issued for his arrest by the Stanislaus County Superior Court. The clerk positively identified Marshall as the suspect. Marshall's bag contained new clothing, such socks, boxer briefs, and T-shirts which came from the Factory 2-U store. Marshall denied stealing and claimed the T-shirts were from another store. Marshall admitted to throwing the socks at the employee but did not believe he hit anyone.

Marshall was booked for making criminal threats against another person, assault and battery, probation violation, and robbery.
